Under 15 U.S.C. § 2066(b) and 15 U.S.C. § 1273(a), the CPSA has the authority to seize and detain products that fail to meet the CPSA regulations. The authority can detain non-compliant products, including recall, seizure, or removal from the market if found to contain hazardous chemicals or substances. However, certain products may be permitted under the provision of Under section 14 of the FHSA, 15 U.S.C. § 1273.
CPSC is a federal agency in the USA that is responsible for ensuring the safety of the products made available for consumers. This includes products containing hazardous materials; many products available for purchase in general stores across the USA contain hazardous chemicals, and CPSC sets regulations for the sale of those products, to prevent accidental injuries or death.
One of the ways to protect consumers is making sure chemical products made available to the public are properly label and packaged, to prevent accidental exposure to harmful chemicals and to provide appropriate instructions on safe use and first aid. For instance, corrosive chemicals must have instructions on the container instructing the user what to do if the product comes in contact with an eye.
CPSC regulates the minimum requirements hazardous products made available to consumers must follow. Products are defined as Hazardous if they meet the requirement for one of the following categories, as described under 15 U.S.C. § 1261:
- Toxic
- Corrosive
- Irritant
- Strong Sensitizer
- Flammable or Combustible
- Pressurized container
- Quick skin-bonding adhesives
- Etc.
CPSC requires hazardous products to be labled according to 16 C.F.R. § 1500.121, in which it is stated labels must provide the following information, in English:
- Signal word (POISON, DANGER, WARNING, CAUTION)
- Statement(s) of the principal hazard(s)
- Common/usual or chemical name of the substance(s) responsible for the hazard(s)
- Precautionary measures describing the action to be followed or avoided
- First-aid treatment instructions, when necessary or appropriate
- Handling and storage instructions for packages which require special care
- ‘’Keep out of reach of children” or equivalent
- Name and place of manufacturer, packer, distributor or seller
